Our lawyers advise on the full range of in-court and out-of-court restructurings, including liability management transactions, amendments and waivers, forbearance arrangements, consensual workouts, distressed acquisitions and dispositions, debt exchanges, recapitalizations, refinancing strategies, receiverships, assignments for the benefit of creditors and formal bankruptcy proceedings. We also represent clients in connection with Chapter 11 reorganizations, Chapter 7 liquidations, cross-border insolvency matters and proceedings involving financially distressed affiliates, counterparties or portfolio companies.

We work with clients from the earliest signs of financial stress through the resolution of a restructuring or insolvency matter. Our advice may involve evaluating liquidity and capital-structure alternatives, negotiating with lenders and other creditors, developing restructuring plans, addressing defaults and covenant issues, preserving enterprise value, managing stakeholder relationships and preparing for potential litigation or a contested proceeding. Where a bankruptcy filing is necessary, we help clients navigate the procedural, strategic and commercial issues that arise before, during and after the case.

Stone Hilton also represents creditors and other parties in bankruptcy and restructuring proceedings, including in matters involving claims, plan negotiations, debtor-in-possession financing, cash-collateral arrangements, adequate protection, executory contracts, leases, asset sales, preference and fraudulent-transfer issues, valuation disputes, intercreditor matters, creditor committees and plan confirmation. We understand that the best result may be a negotiated solution outside of court—or, when necessary, a focused and effective litigation strategy inside it.
